Please read these Terms and Conditions ("Terms") carefully before using our services or website. By scheduling a service, making a payment, or using our website, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and The Frozen Times HVAC ("Company," "we," "us," or "our"), a licensed HVAC contractor operating in Miami-Dade and Broward County, Florida. By engaging our services, you confirm you are at least 18 years of age and have the authority to enter into this agreement.
2. Services Description
The Frozen Times HVAC provides heating, ventilation, and air conditioning (HVAC) services including but not limited to:
- AC installation and replacement (residential and commercial)
- AC repair and diagnostics
- Preventive maintenance and tune-ups
- Duct cleaning, sealing, and replacement
- Indoor air quality solutions
- Emergency HVAC services (24/7)
- Commercial refrigeration systems
All work is performed by licensed, certified HVAC technicians in compliance with Florida state codes and manufacturer specifications.
3. Estimates & Pricing
- Free estimates are provided for installation and replacement projects. Diagnostic service calls may carry a trip charge which is disclosed at time of booking.
- Written estimates are valid for 30 days from the date of issuance unless otherwise stated.
- Prices are subject to change due to material cost fluctuations, additional unforeseen labor, or changes in project scope.
- Any additional work discovered during a service visit will be communicated to you before proceeding, and verbal or written authorization will be obtained.
- Emergency and after-hours service calls are subject to additional fees, which will be disclosed before work begins.
4. Payment Terms
- Residential Repairs: Payment is due upon completion of service.
- Installations & Large Projects: A deposit of up to 50% may be required prior to scheduling. The balance is due upon project completion.
- We accept cash, major credit cards, debit cards, and approved financing options.
- Returned checks are subject to a $35 returned check fee.
- Unpaid balances beyond 30 days may be subject to a 1.5% monthly finance charge and may be referred to a collections agency.
- Financing is available through approved third-party lenders. Terms are subject to credit approval.
5. Scheduling & Cancellations
- Appointments are scheduled based on availability. We will provide a service window and contact you before arrival.
- Please provide at least 24 hours' notice to cancel or reschedule a non-emergency appointment.
- Late cancellations (less than 24 hours) or no-shows may be subject to a cancellation fee of up to $75.
- We reserve the right to reschedule appointments due to weather, emergency calls, or unforeseen circumstances. We will contact you as soon as possible in such cases.
6. Warranty & Guarantee
- Labor Warranty: All repair work is warranted for 90 days from the date of service for the same issue. Installation labor is warranted for 1 year.
- Parts & Equipment: Manufacturer warranties apply to all parts and equipment we install. We will assist you in processing warranty claims.
- Maintenance Plans: Customers enrolled in our annual maintenance plan receive extended labor warranties as outlined in their maintenance agreement.
- Warranties are void if: the system is tampered with by unauthorized persons, misused, neglected, or damaged due to factors beyond our control (power surges, flooding, etc.).
- Warranties are non-transferable unless otherwise agreed in writing.
7. Limitation of Liability
To the maximum extent permitted by applicable law, The Frozen Times HVAC shall not be liable for:
- Indirect, incidental, consequential, or punitive damages arising from the use of our services
- Loss of income, revenue, or profits due to HVAC system downtime
- Pre-existing property damage or code violations discovered during service
- Damage caused by improper operation of equipment by the customer
Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Property Access & Safety
- You agree to provide safe, unobstructed access to all HVAC equipment, electrical panels, and work areas.
- Please secure or remove pets from work areas during service visits.
- Our technicians reserve the right to refuse or stop work if unsafe conditions are present, and will notify you of the issue before leaving.
- You are responsible for clearing the work area of personal belongings and fragile items prior to our arrival.
9. Permits & Code Compliance
Where required by local ordinance, we will pull the necessary building permits for HVAC installations or replacements. Permit fees are the responsibility of the customer and will be itemized on your estimate. We perform all work in accordance with Florida Building Code and manufacturer installation requirements.
10. Intellectual Property
All content on our website — including text, images, logos, videos, and design — is the property of The Frozen Times HVAC and protected by U.S. copyright law. You may not reproduce, distribute, or use our content without express written permission.
11. Dispute Resolution
In the event of a dispute, we encourage you to contact us first to resolve the matter informally. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. Class action lawsuits are waived to the fullest extent permitted by law.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You consent to exclusive jurisdiction in the courts of Miami-Dade County, Florida.
